COYTE, Judge. The People appeal from a judgment of acquittal of a charge of attempt to commit murder in the first degree. Although defendant is not subject to retrial, see People v. Woods, Colo., 510 P.2d 435, the district attorney asserts error in the acquittal and seeks a ruling of precedential value on the emelents of attempted murder. As stated in People v. Kirkland, 174 Colo. 362, 483 P.2d 1349:
